Examples of possible claims
These are scenarios which could happen and lead to a claim;
- Appointment of Head/Deputy Head where references/CRB checks have not been taken up correctly and appointment needs to be terminated.
- Allegations or arrest of staff member and CRB checks have not been maintained.
- Governor breaks confidentiality and discusses items out side of the Governing Body and the school is accused of libel/slander.
- Theft from school funds/PTA or school budget – misuse of school budget – Governing Body responsibility for ensuring systems of check in place and monitoring that School complying with Finance policy.
- Failure to control budget which leads to emergency measures by County Council.
- Neglect of duty – decisions taken on building projects, replacing school boilers proven to be irresponsible and not fully researched / tender process undertaken.
- Incorrect procedures and meetings held not in accordance with Governor Law. Minutes of meetings not recorded adequately.
- Governors/Clerk removed from Governing Body incorrectly.
- Constitution of Governing Body not maintained and therefore decisions taken invalid.
- Failure of Governing Body to ensure correct procedures in place and monitored by school for Child Safety and Safeguarding Children.
- Failure of Governing Body to ensure Health & Safety law at the school complied with.
- The chair / vice chair’s term of office as a Governor ends but they remain in the positions seeing out their term of office as Chair / Vice Chair. This breaks Governor Law.
- Head Teachers Performance Review is unintentionally carried out by a Governor who’s term of office has expired or by a Governor who works at the school.
